Terms of Service

These Terms of Service ("Terms") govern your access to and use of the La Cappella website at lacappellapgh.com ("Site") and the services offered by LA CAP LLC ("Company", "we", "us"). By accessing or using the Site, you agree to be bound by these Terms.

1. Use of the Site

You must be at least 18 years of age to create an account or make a purchase. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You are responsible for maintaining the confidentiality of your account credentials.

2. Subscription Billing and Auto-Renewal

La Cappella offers monthly and annual subscription plans to access premium recipe content. By subscribing, you agree to the following:

  • Free trial: New subscribers receive a 30-day free trial. Your payment method will not be charged until the trial period ends.
  • Auto-renewal: After the free trial (and at each subsequent billing cycle), your subscription automatically renews and your payment method is charged the then-current subscription price. For monthly plans, this is $10.99/month. For annual plans, this is $99.99/year.
  • Cancellation: You may cancel your subscription at any time through your Account page. Cancellation takes effect at the end of the current billing cycle. You will retain access to member content until that date.
  • Price changes: We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

3. Refunds

We offer a 30-day money-back guarantee on all subscription plans. If you are not satisfied within 30 days of your first charge, contact us at info@lacappellapgh.com for a full refund. See our Refund Policy for full details, including product return terms.

4. Intellectual Property

All content on the Site -- including recipes, articles, photographs, graphics, logos and software -- is owned by or licensed to LA CAP LLC and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of or commercially exploit any Site content without our prior written permission. Personal, non-commercial use (such as printing a recipe for your own kitchen) is permitted.

5. User Accounts

You are responsible for all activity that occurs under your account. You agree not to share your credentials with others, not to attempt to access other users' accounts, and not to circumvent or attempt to circumvent any access control mechanism on the Site. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS. RECIPE RESULTS MAY VARY DEPENDING ON INDIVIDUAL EQUIPMENT, INGREDIENTS AND SKILL.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LA CAP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PRECEDING 12 MONTHS.

8. Dispute Resolution -- Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in New York. The parties waive their right to participate in any class action or class-wide arbitration proceeding. You have the right to opt out of arbitration within 30 days of your first use of the Site by emailing info@lacappellapgh.com.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in New York.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.
